Terms of Service

These Terms govern your access to and use of Smart Trips AI ("the Service"), operated by QBITZ AI (sole proprietor, Germany). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility and account

You must be at least 16 years old to use the Service. You are responsible for keeping your sign-in credentials secure and for activity carried out under your account. You agree to provide accurate information and to keep it up to date.

2. The Service

Smart Trips AI generates AI-assisted trip suggestions, detours, deal recommendations, and price alerts. All output is informational and provided "as is". You are responsible for verifying booking details, prices, opening hours, visa requirements, and any other information before acting on it. We are not a travel agency, tour operator, or merchant of record for third-party bookings.

3. Subscriptions and billing

• Paid plans are billed in advance on a monthly or annual basis through Stripe.
• Subscriptions renew automatically until cancelled. You can cancel at any time from the Settings page; cancellation takes effect at the end of the current billing period.
• We may change prices with at least 30 days' notice; price changes apply to the next renewal.
• Taxes are added where applicable.
• Refunds are governed by our Refund Policy.

4. Acceptable use

You agree not to:

• reverse engineer, scrape, or attempt to extract our underlying models or data,
• use the Service to send spam, harass others, or violate any law,
• upload content that infringes intellectual property or contains malware,
• resell or sublicense the Service without our written consent,
• circumvent rate limits or attempt to gain unauthorised access.

We may suspend or terminate accounts that breach these rules.

5. Your content

You retain ownership of trips, notes, and other content you create. You grant us a non-exclusive licence to host, display, and process that content solely to operate the Service for you. We may use de-identified, aggregated signals to improve recommendation quality.

6. Intellectual property

The Service, including its software, design, brand, and content we author, is owned by QBITZ AI and protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-transferable licence to use the Service in line with these Terms.

7. Third-party services

The Service integrates with third parties such as Google Maps, Mapbox, Stripe, and AI model providers. Your use of those services is also subject to their terms. We are not responsible for outages or content provided by third parties.

8. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that AI suggestions will be accurate, complete, or suitable for any particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, travel expenses, or missed bookings. Nothing in these Terms limits liability that cannot be excluded under applicable law (such as for gross negligence or wilful misconduct, or statutory consumer rights).

10. Termination

You can delete your account at any time. We may suspend or terminate your account if you breach these Terms, with or without notice. Sections that by their nature should survive termination (IP, disclaimers, liability, governing law) will survive.

11. Changes

We may update these Terms. We will post the new version with an updated date and, for material changes, notify you by email or in-app at least 30 days before they take effect.

12. Governing law and disputes

These Terms are governed by the laws of Germany, without regard to its conflict-of-laws rules. Disputes are subject to the exclusive jurisdiction of the competent courts in Germany, unless mandatory consumer-protection rules give you the right to sue in your country of residence. EU consumers can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
